In a recent legal development, the Federal Court of Canada upheld the denial of asylum to an Indian couple, Amandeep Singh and Kanwaldeep Kaur, who claimed they would face persecution in India due to their alleged pro-Khalistan activities.
The court found their assertions to be “disingenuous,” stating that the evidence provided were not convincing enough of their claims of political persecution.
The couple sought refuge in Canada, asserting that their participation in pro- Khalistani protests and possession of Khalistan voter cards, would lead to prosecution and potential harm if they returned to India. However, Canadian authorities and the court found their evidence lacking credibility, leading to the rejection of their asylum application.
For India, this is a positive step in safeguarding its sovereignty and combating the global spread of separatist ideologies linked to the Khalistan movement.
Stronger international cooperation and vigilance are key to ensuring that such movements do not find safe havens outside the country.
What is The Khalistan Movement
The Khalistan movement is a separatist campaign that emerged in the 1980s, advocating for an independent Sikh state called Khalistan, primarily in the Punjab region of India. The movement gained international attention following violent incidents, including the 1984 anti-Sikh riots and the bombing of Air India Flight 182 in 1985, which resulted in the deaths of 329 people, mostly Canadians of Indian descent.
While the movement has largely been dormant in India, it continues to have a presence among the Sikh diaspora, particularly in countries like Canada, the United Kingdom, and the United States. In recent years, there has been a resurgence of Khalistani activities abroad, leading to strained diplomatic relations between India and these nations .
Whereas the rejection of the asylum plea underscores Canada’s stance on not granting refugee status to individuals based solely on their political affiliations, especially when such affiliations are linked to movements considered terrorist activities by other nations. This decision may have broader implications for India’s diplomatic relations with Canada, particularly concerning the treatment of individuals associated with the Khalistan movement.
India has consistently expressed concerns over the activities of pro-Khalistan elements operating from Canadian soil, accusing Canada of tolerating such groups under the guise of freedom of expression. The Canadian government’s actions in this case may be seen as a step towards addressing India’s concerns.India’s stance that pro-Khalistan activities have no legitimate basis and should not be protected abroad.
